1. Introduction
The general terms and conditions of sale detailed below (hereinafter referred to as the "Terms and Conditions") exclusively govern the contractual relationship between any user of the Colorsquare.eu website (hereinafter referred to as a "User" or "You") and the merchant Colorsquare.eu belonging to Losdyck Sprl, whose registered office is located at 470 avenue de la Couronne, 1050, VAT number BE 421 179 443 (hereinafter referred to as "Losdyck"). These general terms and conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written derogation. Losdyck may from time to time modify some of the provisions of its general terms and conditions, and it is therefore necessary that these be reread before each visit to the Colorsquare.eu site (hereinafter referred to as the "Site"). These modifications are enforceable from the moment they are put online and cannot be applied to contracts concluded previously. Each purchase on the Site is governed by the general terms and conditions applicable at the date of the order. By validating your order, you unreservedly accept our terms and conditions of sale after having read them. By accessing the Site, you agree to abide by the General Terms and Conditions and the Conditions of Use contained therein.

3. Product information
Losdyck takes the utmost care in providing information on the essential characteristics of the products, in particular by means of technical descriptions from its partners and suppliers and photographs illustrating the products, within the limits of technology and in compliance with the best market standards.
4. Prices
The sale prices indicated on the Site are in euros and include all taxes but exclude delivery charges. Delivery costs, if any, are indicated to the User as he selects his products, and are invoiced at the end of the order in addition to the price of the products selected.
Please note that for the European Union, prices appear in euros on the Site, but also in the currency of the country of shipment for information purposes, without this having any contractual value.
Losdyck declines all responsibility in the event of error or inaccuracy in the conversion system used, i.e. in the event of a difference between the estimated total amount of your order in the currency of the country of dispatch and the amount invoiced in euros.
We reserve the right to modify our prices at any time, but we undertake to apply the current prices indicated on the Site at the time of your order.
Please note that for an order of more than 30 liters of paint with a strong tint, a "dark tint" supplement will be applied.
"Special" promotions and temporary prices for a tintable product are only valid for a light tint. (BASE SEP at Seigneurie).
Please note that in the event of an erroneous or obviously derisory price (low price) being displayed, for whatever reason (computer bug, manual error, technical error, etc.), the order will be cancelled, even in the event of initial validation.
5. Availability
We will honour your order while stocks last.
In the event that one of the products ordered is not available in our stocks, we undertake to contact you by e-mail withinlai of 15 days from the date of your order in order to inform you of this and to let you know how soon this product could, if necessary, be delivered to you.
If some of the products ordered are temporarily unavailable, we undertake to send you the available products and to offer you "shipping costs" for the remainder of the order. We will then offer to send you an item of equivalent quality and price to replace the unavailable product. If you refuse, we will reimburse you for the said product. If you wish to return it to us under the conditions set out in article 9 (withdrawal period - satisfied or reimbursed), the costs will be at our expense.
6. Delivery method
Products purchased on the Site are delivered throughout Europe. Should you wish to have your purchases delivered to another country, you must contact our information department to check whether the destination country is suitable for delivery. Losdyck does not deliver to P.O. Boxes. Your order will be delivered to the address you provided when you placed your order.
When the article is indicated "In Stock" at the time of your order, the delay between the placing of the order and the date of first presentation of the carrier at the determined place is the sum of 2 elements:
1. dispatch time (24 to 48 h) = validation of your payment + preparation of your order + collection of the parcel(s) by the carrier
2. the delivery time for your parcel: You are informed of the start of this time from the moment you receive the "Send order" e-mail.
These times are indicated in working days.

Colorsquare makes every effort to respect the delivery times mentioned on the Site. However, we cannot be held responsible for the consequences of late delivery or loss of a parcel caused by a third party to the contract or by you or due to an unforeseeable and insurmountable cause constituting a case of force majeure. In the event of non-receipt of a parcel within the time limit indicated, an investigation is carried out with the carrier and may take several days (e.g. 15 days for Chronopost). During this period, no refund or return can be made. On receipt of your order, we recommend that you check the conformity of the products delivered with your order and, if necessary, indicate any anomalies on the delivery note in the form of handwritten reservations accompanied by your signature.
Without prejudice to the applicable legal guarantees, we recommend that you send any reservations regarding product defects existing at the date of delivery as soon as possible by post to Colorsquare, Customer Service, 227 Chaussée de Wavre - B-1160 Brussels, fax (+32 647 95 70 ) or e-mail. Products may only be returned in their original condition, i.e. with their packaging, accessories and instructions. Please note that delivery of your order may be delayed by 24 hours. For security reasons, all orders paid by credit card are subject to verification by Losdyck SPRL.
Additional information may be requested, or even required, in order to validate your purchase. In order to avoid any delays, please enter the following information when placing your order:

a valid e-mail address (YAHOO, GMAIL, HOTMAIL,...) or business address.

a landline telephone number (work or home) where you can be reached at any time during the day.

In addition, for all orders over the maximum amount set by Colorsquare, proof of identity and proof of address must be sent to us by fax, e-mail or post. We apologize for any inconvenience caused, but these measures are proof of our desire to protect our customers from credit card fraud.
The denominations "DAY +" mean "Day +". in relation to the days required for delivery of your parcel. "Day +2" means that your package will be delivered within 2 days of the carrier picking it up.

8. Secure payment
Losdyck has chosen to ensure the security of your payments with BIBIT coding when your details are sent over the Internet. When, during payment, one of the symbols (a word is missing here I)or appears, this means that your payment is secure.
Your payment goes through the Bibit PSP, and this name may appear on your account statement.
Losdyck offers 6 payment methods: credit card (CB, Visa or Mastercard), cash, Colorsquare gift voucher, via PayPal and ING Homepay.
Payment by credit card is debited when your order is dispatched, on condition that you have previously obtained authorization to debit your account from the relevant payment centers, failing which your order cannot be processed. Online payment by credit card is made using the "Secure Socket Layer" security system, which encrypts your bank details as they are transmitted over the network.
9. Right of withdrawal. Satisfied or your money back
Losdyck allows you 14 calendar days to return a product that does not satisfy you, without penalty, except for the cost of return. This period starts from the date of delivery of your package.
This right of return can only be accepted for products returned in a condition that allows Losdyck to sell them again (with their accessories, instructions, etc.). Items returned incomplete, damaged or soiled by the customer will not be accepted.
Once you have exercised your right of withdrawal, Colorsquare undertakes to reimburse you in cash for your entire order within a maximum of 30 days.
Colorsquare will not accept "Satisfied or Refunded" returns for the following products:
- Services whose execution has begun, with the customer's agreement, before the end of the cooling-off period
- Customized productss
- Products which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly.
10. Return
Returns may be made via the carrier of your choice. However, it is strongly recommended to return the goods by registered mail or by postal tracking and to subscribe, if necessary, an insurance with the carrier of the market value of the products in order to protect you against any loss or damage of these.
Colorsquare also offers you the possibility of dropping off your products at the Losdyck store whose address is mentioned on the Site, it being specified that no exchange can be made on the spot.
11. Product warranties
The products offered for sale on the Site come with several types of commercial warranties defined below. It is specified that the subscription by the Customer of such commercial warranties does not prevent the application for all the material sold by Losdyck on the Site, whether new or used, of the legal warranty of conformity under the following legal conditions.
In application of the legal warranty of conformity, Colorsquare undertakes to deliver your order in accordance with the sales contract concluded, and is responsible for any defects of conformity existing at the time of delivery.
To comply with the contract, the products must:
1) correspond to the description presented on the Site at the time of your order;
2) be fit for the uses to which products of the same type are usually put or for any other special use sought by the Customer of which the latter would have informed Colorsquare prior to his order and which the latter would have formally accepted; and
3) have the quality and performance customary for a product of the same type which any consumer may reasonably expect, taking into account the nature of the product and the characteristics described on the Site.
Should the lack of conformity be proven, the defective product will be brought into conformity at no cost to the customer.
We remind you that this legal guarantee covers any lack of conformity that appears within 1 year of delivery of your order.
Whatever the problem with your item, we recommend that you enclose with the faulty item the warranty certificate supplied to you on delivery and a returns slip.
We also remind you that the legal warranty may not apply, or may only apply partially, in certain cases, such as:
- repair of damage resulting from a cause external to the device (e.g. accident, shock, lightning, current fluctuation, oxidation, presence of sand, etc.)..),
- customer fault resulting, for example, from use or installation that does not comply with the manufacturer's specifications,
- any lack of conformity of which the customer was aware at the time the order was placed.
Commercial warranties provided by product manufacturers (product failure):
In addition to legal warranties, certain goods sold on the Site benefit from manufacturer warranties, the scope and duration of which vary depending on the product and brand.
Generally, manufacturers' warranties do not cover :
- replacement of consumables (batteries, bulbs, fuses, wear and tear of recording or playback heads, etc.);
- abnormal or non-compliant use of products;
- damage caused by the intervention of a reparateur non agréé par le constructeur;
- damage resulting from a cause external to the device (for example, accident, internal or external shock, lightning, current fluctuation, oxidation, presence of sand...).
We therefore invite you to carefully consult the instructions for use supplied with the products and the exact terms of any manufacturer's warranties that may apply.
In all cases, Colorsquare cannot be held responsible if the manufacturer refuses to apply its warranty for the above-mentioned reasons.
When the manufacturer's warranty is not applicable, the repair will be subject to an estimate drawn up by the manufacturer. Administrative charges may be billed to you by the manufacturer if you request the return of your product without the repairs proposed by this estimate. You may also choose to abandon your product at no extra charge.
12. Comments, criticism, communication
All reviews posted by Colorsquare Users are monitored and moderated by the marketing team. Colorsquare reserves the right to refuse or modify any review that violates the law or ethics (abusive advertising, defamatory statements, insults, comments out of context, etc.).
13. Protection of personal data
The information you provide us with is essential for the processing and delivery of orders, the preparation of invoices and warranty contracts, and their absence will result in the cancellation of your order. By registering on the Site, you agree to provide us with true and accurate information about yourself. The communication of false information is contrary to the present general conditions as well as to the conditions of use appearing on the Site.
Colorsquare is authorized to collect, process and use information about you. This data is processed electronically.
You have a permanent right of access and rectification on all data concerning you, in accordance with European texts and national laws in force.
You may at any time make a request to Colorsquare to find out what information it holds on you. You may modify this data at any time and on request. If you have agreed to this when logging on to the Site, promotional emails (electronic mails) proposing new products, clearance offers, exclusivities, bargains, etc. will be sent to you. You may request to no longer receive e-mails from us at any time by clicking here or on the link provided for this purpose and inserted in the footer of each e-mail that we or one of our partners will send you. Colorsquare is the sole owner of your personal information. If you have accepted it when identifying yourself on the Site, Colorsquare and its contractual partners may send you information within the framework of specific and punctual promotional operations. These partners are specially chosen by Colorsquare and are recognized for the quality of their products and services.
14. Intellectual property rights
The entire content of the Colorsquare website (illustrations, texts, labels, trademarks, images, videos) is the property of Losdyck SPRL, its co-contractors or partners. Any partial or total reproduction of the content by any process whatsoever and on any medium whatsoever is subject to the prior and express authorization of Colorsquare.
All information, content, files and software offered by our services are protected by Belgian and international laws concerning intellectual property and copyright.
Losdyck cannot give you permission to copy, display or distribute any content for which you do not own intellectual property rights. Any use of these contents in fraud of the rights held by third parties on these is constitutive of the offence of counterfeiting, severely sanctioned by the Code of Intellectual Property.
Losdyck and Colorsquare shall in no event be held liable for any violation by a user of rights held by third parties and perpetrated as a result of the latter's activities on the Site.

Both parties undertake to settle amicably any dispute arising from the present agreement. In the event of failure, the courts of Brussels shall have sole jurisdiction.
